2024 Unsung Pals Terms and Conditions
Terms and conditions:
Definitions:
- Nominator (The pal who nominates the community pal) – means the person submitting the application
- Nominee (The community pal) – means the person nominated in the application
- Recipient/Nominee recipient – means the winner of the competition
- Pals – means “Master of Ceremonies Limited”
- Reward (to the nominee) – means the reward chosen by the nominee recipient pursuant to the terms and conditions
- Donation – means the payment to the chosen charity pursuant to the terms and conditions
- Initiative - means the ‘Unsung Pals’ competition.
Application
Applications will be open from from Wednesday 19th June at 6pm until Wednesday 17th July at 12pm. Open to NZ & Aus residents only. Terms and conditions apply.
Any entries after or before that date will not be accepted.
Entries will only be accepted via the form on the website at: www.drinkpals.co.nz/unsungpals and no other method will be accepted.
To be valid, each application must fill out all the required information on the form with a valid email and phone number and agree to these terms and conditions on behalf of the nominator and nominee and certify that the application is true to the best of their knowledge.
Failure to supply all requested personal information at the time of submitting an entry might result in the entry being invalid. No responsibility will be taken for incomplete entries.
Submission of application will be deemed acceptance to these Terms and Conditions. Pals reserves the right to amend the terms and conditions at any time including extending, postponing or cancelling the competition.
Eligibility:
To be eligible for the competition, your nominee must meet all the following criteria:
- Any New Zealand or Australian resident over the age of 18 years old who is making a positive long-term difference in their local community without any commercial gain to themselves.
- The local community must be in New Zealand or Australia and where the nominated pal resides permanently.
- Making a ‘positive difference’ could include raising awareness of societal issues, encouraging participation or improving the livelihood of their community and their spaces.
- The nominated community pal must have been making a positive difference in their community within the last 12 months.
- Accepts the terms and conditions.
The Nominator must also be over the age of 18 years old.
Pals shall determine, in its sole discretion, whether an application meets the eligibility criteria. There is no requirement to purchase Pal’s products, or any payment of any kind required to apply. A purchase of Pals products will not improve your chance of selection.
Employees of Pals and their immediate family members (spouses, parents, siblings, children – whether by blood or marriage) are not eligible for the competition.
The reward & donation:
Pals will choose one nominee recipient. The nominee recipient shall be entitled to a reward and a charity donation pursuant to these terms and conditions.
$5000 reward given to the nominee recipient:
The reward to the nominee recipient can be up to the value of $5,000 NZD including GST and postage. If the reward is under $5,000 NZD, Pals will not give the remaining value of $5,000 NZD to the nominee recipient.
The reward can only be given for nominations that will have a positive impact on the nominee’s lifestyle. Reward nominations cannot be a purchase of illegal, hazardous or damaging items or services and all entries of this manner will be excluded from the competition. Pals reserves the right to refuse to provide the requested reward if Pals, in its sole discretion, does not believe the reward will make a positive impact on the nominee recipient’s lifestyle.
The chosen reward will be arranged and purchased by Pals. Pals will not be liable for any delay in supplying the reward.
$20,000 donation to charity or community work:
Pals will donate $20,000 NZD including GST and any other applicable tax to be spent directly on positively progressing their community work or to a New Zealand or Australian registered charity. The requested donation must help positively progress the community initiative and Pals reserves the right to reject any suggestions that do not meet this objective. The nominee recipient will make recommendations on how they would like the donation to be made but Pals will be the final decision maker.
If the nominee recipient chooses for the donation to be spent on their community project, the $20,000 (including GST and any other applicable taxes) will be paid by Pals to nominated suppliers from one or more registered businesses on the production of a GST invoice for the items or services the nominee recipient requires to progress their community work. The nominee recipient may request multiple payments to different suppliers and payment will be at Pals sole discretion. It will not be given as a cash donation. If they nominate a registered charity, Pals will donate directly to the charity itself.
The reward or donation is not transferable or exchangeable and cannot be redeemed for cash.
Pals is not liable for damage to reward or donation sent by post or courier.
Pals takes no responsibility for any variation in the value of the reward or donation.
Any tax payable by the nominee recipient or the nominated charity will be their sole responsibility and Pals will have no responsibility for the nominee recipient’s or the nominated charity’s tax obligations.
Subject to any applicable law which cannot be excluded, Pals and their employees are not responsible for any loss or damage whatsoever that is suffered (including but not limited to indirect or consequential loss) or for personal injury suffered or sustained during the course of accepting or using the reward or donation.
Nominee Recipient selection:
All valid applications will be reviewed by the Pals team internally.
The finalists and nominee recipient will be selected based on the positive impact this person has made in their local community with a great story, showing clearly how the donation could make a big difference and a reward idea for your Unsung Pal that really benefits them.
Pals will notify the nominator & nominee finalist by email and/or telephone. Being selected as a finalist does not guarantee you will receive the award. Pals may request to send proof of their community work including but not limited to photos, links, emails with proof of their community work, contacts details of a third party to verify the application. Pals may request the nominee to put forward how they would plan to donate the $20,000. If the nominee plans to spend it on their community work, Pals will request from the nominee how they plan to spend the $20,000 on their work and what the material impact will be to make the final decision.
By entering, the nominator and the nominee agree to their names being published and to be photographed, filmed and/or interviewed by Pals and that Pals may use their names and such photographs and/or interviews for publicity purposes.
Pals will notify the nominator recipient by email and/or telephone. All reasonable attempts will be made to contact winners. Should those attempts fail, the runner up will be chosen. Pals will arrange a call with the nominee to award them with the prize, together with the nominator. Pals will then agree a time to award the prize and photograph and film the recipient for Pal’s communications.
Involvement in the initiative requires both the nominator and nominee to agree to these terms and conditions. Submission of application will be deemed acceptance to these Terms and Conditions by the nominator. The nominee will be required to provide consent to these terms and conditions when contacted by Pals. If the nominee does not provide acceptance then the nominee will automatically become ineligible for the initiative. Pals reserves the right to amend the terms and conditions at any time including extending, postponing or cancelling the competition.
Privacy
Any information provided by you as part of the application process will be processed in accordance with Pals Privacy Policy. By submitting your application, you agree to Pals privacy policy and consent to receive communications and other materials from Pals regarding the competition. If you provide us with personal information of a reference or any other individual as part of your application, it is your responsibility to obtain consent from that individual prior to providing such information to us.
These Terms and Conditions shall be governed by and construed in accordance with the laws of New Zealand.
